Terms of Service

1. Acceptance of Terms

By accessing or using the tester.army platform and related services (the "Service") operated by TesterArmy ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the authority to enter into these Terms on behalf of yourself or your organization.

2. Description of Service

TesterArmy is an AI-powered QA testing platform. You provide website URLs, optional credentials, and test instructions. Our AI agent executes automated tests, captures screenshots, and delivers results through a chat interface. The Service also includes team collaboration, GitHub repository integration, scheduled test runs, API access, and webhook delivery.

3. Account Registration

To use the Service, you must create an account using Google OAuth, GitHub OAuth, or email magic link. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account and authentication credentials
• Notify us immediately of any unauthorized access to your account
• Not create multiple accounts for the same individual
• Receive product updates, feature announcements, and other communications from us via email. You may unsubscribe from these emails at any time using the unsubscribe link included in each email.

You are responsible for all activity under your account, including actions taken by team members you invite.

4. Teams & Collaboration

The Service supports team-based collaboration with role-based access:

• Owner - full control including billing, membership, and team deletion
• Admin - manage projects, members, and settings
• User - access projects and run tests

Team owners are responsible for managing access and ensuring team members comply with these Terms. Invitations expire after 7 days and can be revoked at any time.

5. Subscription & Payment

Paid features are available through subscription plans managed via Stripe. By subscribing, you agree to:

• Pay the applicable fees for your selected plan and seat count
• Provide valid payment information through Stripe's secure checkout
• Accept automatic renewal at the end of each billing cycle unless cancelled

We may offer trial periods at our discretion. Prices may change with 30 days' notice. Subscription downgrades or cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods or unused time.

6. Acceptable Use

You agree not to:

• Test websites you do not own or do not have explicit authorization to test
• Store credentials for websites or accounts you do not own or have permission to access
• Use the AI agent for purposes other than QA testing (e.g., scraping, data extraction, or unauthorized automation)
• Attempt to extract, reverse-engineer, or replicate the AI model or its outputs
• Abuse API keys, exceed rate limits, or circumvent usage restrictions
• Share account credentials, API keys, or session tokens with unauthorized parties
• Upload malicious content, attempt to compromise the Service, or interfere with other users
• Use the Service to violate any applicable law, regulation, or third-party rights

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

7. AI-Generated Content

The Service uses AI models to generate test results, identify potential bugs, and provide QA insights. You acknowledge and agree that:

• AI-generated results are not guaranteed to be accurate, complete, or error-free
• The Service is not a replacement for manual QA testing, security audits, or professional testing services
• AI output may contain false positives, miss actual bugs, or provide incorrect analysis
• You are solely responsible for validating and acting on AI-generated results
• We are not liable for any damages resulting from reliance on AI-generated content

8. Credential Storage

The Service allows you to store website credentials for automated test execution. These credentials are encrypted at rest using AES-256-GCM and decrypted in-memory only during active test runs. You acknowledge that:

• You are solely responsible for the credentials you store
• You must only store credentials for accounts you own or are authorized to use
• Credentials are transmitted to AI providers during test execution as necessary to perform the tests you request
• You may delete stored credentials at any time
• While we employ strong encryption, no system is completely immune to breach

9. Intellectual Property

Our property: The Service, including its software, design, AI models, branding, and documentation, is owned by TesterArmy and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

Your property: You retain ownership of all data you provide to the Service, including project configurations, test instructions, and stored credentials. Test results and AI-generated outputs are provided to you as part of the Service - you may use them freely for your internal purposes.

Feedback: Any suggestions, ideas, or feedback you provide about the Service may be used by us without obligation or compensation.

10. API Usage

The Service provides API access via API keys. You agree to:

• Keep API keys confidential and not share them with unauthorized parties
• Use API keys only for their intended purpose within the Service
• Respect rate limits and usage quotas associated with your plan
• Rotate or revoke keys immediately if you suspect unauthorized access

API keys have configurable expiration (default 90 days) or can be set to never expire. We reserve the right to revoke API keys that are used in violation of these Terms.

11. GitHub Integration

By connecting a GitHub repository, you authorize TesterArmy to:

• Receive webhook events (deployments, pull requests, pushes) from your repository
• Post comments on pull requests with test results
• Access repository metadata (name, default branch, deployment status)

You may disconnect the GitHub integration at any time through your project settings. Disconnection stops future webhook processing but does not delete historical test data.

12. Shared Content

You may generate share links for chat sessions. Shared sessions are accessible to anyone with the link without authentication. You are responsible for:

• Ensuring shared content does not contain sensitive or confidential information you do not wish to expose
• Understanding that we cannot control who accesses a shared link once distributed
• Revoking share links if they are no longer needed

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.

14. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Third-party service outages (AI providers, cloud infrastructure)
• Force majeure events beyond our reasonable control

We will make reasonable efforts to notify users of planned downtime in advance.

15. Limitation of Liability

To the maximum extent permitted by law, TesterArmy's total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

In no event shall TesterArmy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.

16. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated test results will be accurate or complete
• The Service will detect all bugs, vulnerabilities, or issues in your websites
• Stored credentials will remain secure under all circumstances

17. Indemnification

You agree to indemnify, defend, and hold harmless TesterArmy and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service in violation of these Terms
• Testing websites without proper authorization
• Mishandling of stored credentials
• Any content you provide, share, or make available through the Service
• Your violation of any applicable law or third-party rights

18. Termination

Either party may terminate the account relationship at any time:

• You - by cancelling your subscription and deleting your account through the Service settings
• We - by providing reasonable notice, except in cases of Terms violations where we may terminate immediately

Upon termination, your right to access the Service ceases. Account deletion is permanent and immediate - all associated data is deleted at the time of deletion, except where retention is required by law (e.g., billing records).

19. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. Each party bears its own costs unless the arbitrator rules otherwise.

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property or data security.

20. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by email or in-product notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

21. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TesterArmy regarding the Service, superseding any prior agreements.
